eDiscovery - Rule 37(f)

Rule 37(f) limits rule-based sanctions for failure to provide information in discovery when the loss results from a "routine, good-faith" operation. This provides a Safe Harbor where data may be deleted due to the ways in which information systems are generally designed, programmed, and implemented to meet the party’s technical and business needs. Disaster recovery tapes and active data are routinely overwritten or discarded for policy reasons unrelated to litigation are excluded, but exceptional circumstances can always trump. Information preserved for one case is theoretically available for other cases, compounding the volume, and increasing the burden and complexity of searching for discoverable information.
